1. Description of the Service
DailyGestures is a web-based drawing practice application that provides timed drawing sessions, reference images, and a personal sketchbook. The service is offered by Max Freytag ("Operator") as an individual under German law.
2. User Accounts
You may use basic features without an account. Creating an account (via Google or email/password) unlocks syncing, statistics, and the sketchbook. You are responsible for keeping your login credentials secure. You may delete your account at any time via the Account page.
3. Subscriptions & Payments
Paid plans (Pro, VIP) are billed monthly or annually through Stripe. By subscribing you agree to recurring charges until you cancel. You may cancel at any time; access continues until the end of the current billing period. Refunds are handled on a case-by-case basis in accordance with applicable consumer protection laws (§ 312g BGB, EU Consumer Rights Directive).
4. Acceptable Use
You agree not to: (a) use the service for any unlawful purpose, (b) attempt to gain unauthorized access to our systems, (c) interfere with the service's operation, or (d) use automated means to scrape or abuse the API.
5. Intellectual Property & User Content
Your drawings belong to you. By saving drawings to the sketchbook, you grant us a limited license to store and serve them back to you. We do not claim ownership of your content.
Reference images are sourced from Unsplash under the Unsplash License. They are provided for practice purposes only and may not be redistributed.
The DailyGestures name, logo, and application code are the property of the Operator and may not be used without permission.
6. Limitation of Liability
The service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, or consequential damages. This does not affect mandatory liability under German law (e.g. intent, gross negligence, injury to life/body/health, § 521 BGB).
7. Termination
You may stop using the service at any time. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your right to use the service ceases and your data will be deleted per our Privacy Policy.
8. Governing Law & Dispute Resolution
These terms are governed by the laws of the Federal Republic of Germany. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
9. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via in-app notice or email. Continued use after changes constitutes acceptance.
